Terms of Service

1. Acceptance of Terms

By accessing or using the Pocket Quote mobile application ("App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Pocket Quote is operated by CMS Hub ("Company", "we", "us", or "our"). We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

Pocket Quote is a mobile application designed for professionals in the heavy construction materials industry. The Service allows users to:

  • Create and manage professional quotations
  • Store product and client information
  • Generate and share PDF quotes
  • Track quotation history and status
  • Manage pricing and tax configurations

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription and Payments

Pocket Quote offers both free and premium subscription plans. Premium features require a paid subscription. By subscribing, you agree to:

  • Pay the applicable subscription fees
  • Automatic renewal of your subscription unless cancelled before the renewal date
  • Subscription management through your device's app store (Apple App Store or Google Play Store)

Refunds are handled according to the policies of the respective app store where you made your purchase. We do not directly process payments or handle refunds.

5. User Content

You retain ownership of all content you create using the Service, including quotations, client information, and product data ("User Content"). By using the Service, you grant us a limited license to:

  • Store and process your User Content to provide the Service
  • Create backups for data protection purposes
  • Display your User Content to you within the App

You are solely responsible for your User Content and ensuring it does not violate any laws or third-party rights.

6. Intellectual Property

The Service, including its design, features, and functionality, is owned by CMS Hub and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer or attempt to extract the source code
  • Use our trademarks, logos, or branding without written permission
  • Remove any copyright or proprietary notices from the App or its content

7. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malicious software or harmful code
  • Interfere with or disrupt the Service or its underlying infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any fraudulent or illegal purpose

8. Termination

You may terminate your account at any time by deleting your account through the App settings or contacting our support team. We may suspend or terminate your access to the Service at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • Any other reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. You may request export of your data before account deletion.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • The results obtained from using the Service will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CMS HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CMS Hub, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CMS Hub is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice in the App or sending an email to registered users. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.
